PROTECT RIGHT TO HUNT AND FISH.

House amendment makes the following changes to 3rd edition. Amends proposed Article I, Section 38, of the North Carolina Constitution, providing that public hunting and fishing are to be the preferred means of managing and controlling wildlife. Removes provision that this section is not to be construed to modify any provision of law relating to public safety or the regulation of commercial activities. Provides that, if approved, new Section 38 would be effective upon certification.

Senate committee substitute makes the following changes to the 1st edition. Amends proposed new Section 38 of Article I of the North Carolina Constitution to provide that nothing the section modifies any provision of law related to public safety, trespass, property rights, eminent domain, or the regulation of commercial activities (was, related to trespass or property rights). Deletes the provision making the Constitutional amendment effective upon certification.

Subject to approval by voters at the statewide election in November of 2018, adds new Section 38 to Article I of the North Carolina Constitution giving the people of the state a right to hunt, fish, and harvest wildlife, subject only to laws enacted by the General Assembly and rules adopted according to authority granted by the General Assembly to (1) promote wildlife conservation and management and (2) preserve the future of hunting and fishing. Makes public hunting and fishing a preferred means of managing and controlling wildlife. If approved, effective upon certification of the amendment to the Secretary of State.
